LagunaJobs.com is an online platform which connects businesses that are looking to engage temporary staff (job seekers or “Talent”) on an ad-hoc basis to meet their particular requirements, such as covering events, (each such business being the “Business Partner”)with individuals who are looking for ad-hoc opportunities to provide their services including but not limited to full time job with unlimited qualification around Thailand.

Access to and use of the contents and services provided on the Lagunajobs.com and app shall be subject to the term and conditions which are set out below (“Terms and Conditions“) and the privacy statement (“Privacy Statement“). If you do not accept either or both of the Terms and Conditions and/or the Privacy Statement, please do not join, access, view, download or otherwise use any services offered by lagunajobs.com via the Site and/or application. By your continued use of the service, you acknowledge that you have read and understood the Terms and Conditions and the Privacy Statement and that you agree to be bound by all of its provisions. Lagunajobs.com reserves the right to amend, add to, delete or revise the Privacy Statement and the Terms and Conditions at any time without prior notice. You are advised to periodically review the Privacy Statement and the Terms and Conditions. Your access to the Site and Lagunajobs.com’s services will be terminated upon your notice to Lagunajobs.com that any change is unacceptable; otherwise your continued use shall constitute your acceptance of all changes and they shall be binding upon you.

  1. Definitions
    1. In these Terms and Conditions, the following terms shall have the respective meanings specified below unless the context otherwise requires:
      “Account” means the Laguna Jobs account you open when you register to become a Business Partner and use Laguna Jobs’s Service;
      “Assignment” or “Job descriptions” means a description of services required that is posted by a Business Partner on the Service which includes without limitation the pay rates, times and locations for the performance of those services;
      “Business Partner” means user who places a job advertisement or promotes any job related activities via the Site.
      “Engagement” means a Business Partner’s engagement of a talent via the Service to provide talent Services in respect of any Assignment;
      “Laguna Jobs” means Lagunajobs.com
      “Laguna Phuket” means Laguna Resorts and Hotel Plc.
      “Talent(s)” means users seeking employment.
      “Identity” means Login name or Username, Password, PIN - Personal Identification Number, fingerprint, biometric face, password for using device for making transactions, OTP - One Time Password, including other codes related to the access to electronic services, whether called by any name. And whether it is a code assigned by Laguna Jobs or a user-defined header
      “Site” means any website, job portal or mobile application owned and operated by Laguna Jobs and its affiliates/subsidiaries or its service providers.
    2. The terms “you”, “user” and “users” herein refer to all individuals and/or entities accessing and/or using the Site at any time for any reason or purpose.

  2. Acceptable Site Uses
    2.1 Specific Uses – Business Partner
    1. Business Partner agrees that it shall only use the Site for lawful purposes and promoting any job related activities.
    2. Upon the account is verified, Business Partner will be entitled to use the Site to advertise job vacancies on the Site. Subject to the conditions or requirements from time to time stipulated by Laguna Jobs regarding the access to Talent’s information or data, Business Partner will be entitled to access the Database but agrees that all information or data obtained as a result of such access shall only be used for the sole purpose of recruiting and assessing the suitability of Talents and that such information or data shall not be disclosed to any other parties without the prior consent of the Talent concerned. Business Partner acknowledges and agrees that it shall disregard any information or data received from Talent which is irrelevant to recruiting and assessing the suitability of Talents.
    3. Business Partner shall be solely responsible for the contents of and materials contained in its job advertisement on the Site. Laguna Jobs reserves the right to remove or edit, or require the removal or amendment of, any advertisement as it sees appropriate, or to terminate or suspend the Business Partner’s access and use of the Site and/or services offered on or through the Site, in accordance with the agreement for such services between Business Partner and Laguna Jobs.
    4. Laguna Jobs shall have the right to terminate any services offered to any Business Partner and to remove any advertisement posted on the Site at Laguna Jobs’s sole discretion, without any compensation or recourse to Business Partner in the event that the relevant Business Partner or the contents of the relevant advertisement is or are in breach of any of the provisions herein or any of the provisions in the Terms and Conditions of Sale or any Laguna Jobs Products’ specifications.
    5. Laguna Jobs also reserves the right to change the service fee or institute new charges or fees as appropriate. In the event that any Business Partner fails to pay the service fee or any other fees or charges to Laguna Jobs, Laguna Jobs reserves the right to suspend or terminate the Business Partner’s web page and/or advertisement and/or right to access the Database, without prejudice to all other rights and remedies available to Laguna Jobs.
    6. All Business partner user Accounts are associated with individuals. All Users are responsible for their Accounts, including making sure that all User details are correct and kept up-to-date and for ensuring that their password is secure. If a business partner has any reason to believe that its Account is being used by anyone else, contact us immediately on lagunajobs@lagunaphuket.com. If we believe that a business partner’s Account has been compromised, we may suspend that account and will contact the business partner to try and resolve the problem.
    7. Laguna Jobs reserve the right to refuse to register any person or entity as a User.

    2.2 Specific Uses – Talent
    1. Talent agrees that he/she shall only use the Site for lawful purposes and seeking employment.
    2. Talent agrees to keep his/her login name and password with care and not to disclose them to any other person. Talent is solely responsible for maintaining the confidentiality, safekeeping and security of such login name and password and shall notify Laguna Jobs immediately of any unauthorized use of the same.
    3. Talent confirms and acknowledges that he/she discloses his/her personal data to the Business Partner and/or Laguna Jobs of his/her own volition when he/she applies for available job vacancies posted on or through the Site, and/or when Talent uses the Site for purposes of submitting, uploading or posting his/her resume on the Site. By submitting, uploading or posting his/her resume on the Site, Talent authorizes Laguna Jobs to store his/her resume and information or data related thereto in the database of Laguna Jobs (“Database“). Talent may send his/her resume and the related information or data directly to any business partner who advertises the job on or through the Site. Alternatively, Talent may send his/her resume and the related information or data to Laguna Jobs through the Site in reply to any job advertisement. In such event, Talent’s resume and the related information or data will remain active on the Site and be stored in the Database at his/her own risk unless and until he/she chooses to delete them. Talent acknowledges and agrees that his/her resume and the related information or data may be accessed by the Business Partner who have subscribed to the services of Laguna Jobs for the sole purpose of recruiting and assessing the suitability of Talents. Laguna Jobs also reserves the right to reject, disapprove or edit any part of the Talent’s resume and information or data related thereto as it sees appropriate and to erase any personal data which Laguna Jobs reasonably believes that such information or data are inaccurate, false, illegal, unlawful, infringe copyright / trademark / trade name / trade secret or infringe any other intellectual property rights or invade the privacy of the other having regard to the purpose (including any directly related purpose) for which the data are or are to be used.
    4. Laguna Jobs will not release Talent’s personal data to any business partner without his/her permission unless required by any authorized institution or obliged under the prevailing laws and regulations. Talent acknowledges and agrees that Laguna Jobs will, if he/she so authorizes, release his/her resume (without his/her personal and contact information and name of his/her current employer) to business partner through the use of Laguna Jobs’s search engine or any other means for the sole purpose of enabling business partner to recruit and assess the suitability of Talents in relation to any job vacancy. Talent agrees that Laguna Jobs and its associated companies may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposes which may be directed to either potential Business Partner, their respective agents or anyone under their employ.
    5. Although Laguna Jobs shall use its reasonable endeavors to restrict access to the Database only to the Business Partner and personnel of Laguna Jobs, it does not guarantee that other parties will not, without Laguna Jobs’s consent, gain access to the Database. However, Talent acknowledges that the Business Partner and other parties who have otherwise gained access to the Database may have retained a copy of Talent’s resume. Laguna Jobs is not responsible for the retention, use or privacy of resumes in these instances, or for the use or privacy of resumes by any of such parties while the resumes are in the Database.
    6. Laguna Jobs will not be responsible or held liable in any way if any Business Partner or other user, in breach of the Terms and Conditions, whether in Thailand or elsewhere, uses the Talent’s personal data, information or materials for any purpose other than for recruiting potential employees. Talent accepts that all personal data, information or materials given to Business Partner or other users, or submitted on or through the Site, are given entirely at his/her own risk.
    7. Talent must understand and agree that using this platform means they consent to operate as independent contractors only and do not have any legal relationship or employment status with Laguna Jobs or its clients, either under current or future legal agreements, in accordance with the Labor Protection Act, B.E. 2541 (1998). The provision of the Talent’s services shall be terminated when the employer accepts the work in full. If the Business Partner wishes to open a new service request with the same or similar details as the original request, by expressing their intention to hire the same Talent or not, the Talent has the right to consider whether to provide the service or not, and Laguna Jobs has no right to force or command.

    Employment conditions included
    1. Talent has accepted the details of employment and rate of hire for each job after accept the job offer.
    2. As part of its Service, Talent will use reasonable endeavors to confirm the Talent’s identity and verify that the Talent has the required skills, qualifications and experience to apply for Assignments and undertake Engagements with the Business partner. Notwithstanding the foregoing, Laguna Jobs shall not be liable or responsible to the extent it has been provided with misleading, incorrect, inaccurate, false or fraudulent information by a Talent.
    3. It is the Business Partner’s responsibility to supervise the Talent(s) assigned to their Engagements and to ensure that the talent(s) provide the Talent Services in accordance with the business partner’s reasonable instructions and to the business partner’s reasonable satisfaction.
    4. If talent leave the work place without informing, Laguna Jobs reserve the right to consider to pay for the wage.
    5. The applications for receiving money are a copy of bank book and identification card which are the same person.
    6. Direct acceptation of work from employers is forbidden (which mean direct acceptation of work from Laguna Jobs’ business partner). Because these terms and conditions of the application, part-time of talent is only authority of Laguna Jobs. If talent has got any work problems without applying via Laguna Jobs, Talent must be responsible by self.

    2.3 Prohibited Uses – Users
    Users agree(s) that:
    1. All users shall not use the Site in any manner that infringes the intellectual property rights or proprietary rights of others.
    2. All users shall not print, download, duplicate, transmit or otherwise copy, reproduce, re-distribute, republish or use any personally identifiable information about other users save and except that the Business Partners may use the Database and/or Talents’ resumes and the information or data related thereto pursuant to Clause 1.b. as above. All unsolicited communications of any type to users are strictly prohibited.
    3. All users shall not delete, revise or remove any material posted by any other person or entity.
    4. All users are prohibited from violating or attempting to violate the security of the Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mails, including promotions and/or advertisements for products or services. Violations of system or network security may result in civil and/or criminal liabilities.
    5. All users shall not upload, post, publish, transmit, distribute, circulate or store any material in whatsoever way relating to the Site (i) in violation of any applicable laws or regulations; (ii) in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights or proprietary rights of others or violate the privacy or publicity or other personal rights of others; (iii) that is harmful, defamatory, libelous, obscene, discriminatory, harassing, threatening, abusive, hateful, racist, blasphemous, false, illegal, improper or is otherwise offensive or objectionable; (iv) in the manner that causes unrest in politics, religion, national security or stability of Laguna Jobs; or (v) that contains viruses, trojan horses, worms, corrupted files or other materials or programs that may interrupt, damage or limit the functionality and operation of the Site, the services offered on the Site, or of any computer software or hardware or telecommunication equipment.
    6. All users are prohibited in using screen scraping, data mining, robots or similar data gathering and extraction tools on the Site for establishing, maintaining, advancing or reproducing information contained on our Site on your own website or in any other publication, except with our prior written consent.
    7. Business Partner user agree that you will not:
      1. impersonate any other person, conduct yourself in an offensive or abusive manner, or use the Service for any unlawful purposes;
      2. fail to deliver the payment for the Talent Services rendered to you;
      3. advertise or offer to sell any goods or services for any commercial purpose through the Service which are not relevant to the services offered via the Service;
      4. use the Service to solicit for any other business or service, or contact Talent for employment (or any other purpose) not related to use of the Service as envisaged by these Terms of Service;
      5. post the same Assignment repeatedly;
      6. use virtual private networks, false email addresses or any other means to mask your identity;
      7. attempt to access the accounts of other Users or upload, share or submit content containing any spy ware, adware, viruses, corrupt files, worm programs or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information;
      8. disable or modify any copy protection technology used on the Service;
      9. abuse or manipulate the rating/review system on the Service;
      10. upload, share or submit content that is or may be interpreted as obscene, indecent, pornographic, sexually explicit, libelous, maliciously false, inaccurate, misleading, depicting violence (in an explicit, graphic or gratuitous manner) offensive, deceptive, threatening, abusive, harassing, menacing, hateful, discriminatory or cause annoyance, inconvenience or needless anxiety to any person or be in breach of hate speech or discrimination legislation;
      11. upload, share or submit any content that infringes any proprietary rights of any third party including any patent, copyright, moral right, database right, trade mark right, design right, trade secret rights in passing off, rights of privacy, publicity, confidence, or under data protection legislation or other intellectual property law;
      12. upload, share or submit any content that is false, deceptive, misleading, deceitful, false, inaccurate or akin to a ‘bait and switch’ offer;
      13. do or omit to do anything which would bring us, the Service, our suppliers or other Users into disrepute or in any way damage our or their reputation; or
      14. interfere with another User’s use and enjoyment of the Service in any other manner that could damage, disable, over burden or impair the Service.
    8. We may suspend, restrict or terminate your Account and/or your access to the Service if we believe that you have breached these Terms of Service. This does not limit our right to take any other actions against you that we consider appropriate to protect our rights.

  3. Content on our Service
    1. Laguna Jobs may change or remove content, functionality or parts of our Service at any time.
    2. The legal rights (including the intellectual property rights) in Laguna Jobs Service and any content on it is owned by us, or licensed to us by third parties. Laguna Jobs Service and content is protected by international copyright laws and database rights. Save for the limited right to use the ordinary functionality of the Service as granted under these Terms of Service, nothing on Laguna Jobs Service grants you any license or right to use, alter or remove such material. Business Partner may not use our trade marks, logos or other intellectual property without our prior written approval.
    3. From time to time, our Service may include links to other websites, applications or web properties. These links are provided for your convenience to provide further information. Laguna Jobs have no control over, or responsibility for, the content of the linked websites, applications or web properties.
    4. Laguna Jobs do not guarantee that the Service, or any content on it, will always be available or be uninterrupted. The quality of the Service may be affected by a number of factors including, for example, network connection and internal network, as well as any interference or maintenance work. If a disruption or disturbance occurs on the Service or a part of it or if the Service or a part of it is temporarily out of use or inoperative due to repair or maintenance work, updates or reasons beyond our control (force majeure), you accept that such interruptions, disturbances or disruptions do not constitute a defect or delay of or in the Service, and, to the extent permitted by law, Laguna Jobs shall not be liable for any consequences of or damages resulting from such interruptions, disturbances or disruptions. Laguna Jobs or a third party shall seek to repair the problems or failures as soon as possible and to restore the Service to use as soon as possible under the circumstances. Laguna Jobs have the right to update the software included in the Service from time to time.
    5. Your access to our Service may also be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will endeavour to restore the Service as soon as we reasonably can.
    6. We do not guarantee that the Service, or any content on it, will be free from errors or omissions.

  4. User License
    1. Laguna Jobs allow Business Partner to post descriptions of Job Assignments (which may include, for example, text, information and/or other types of content) (the “Content”).
    2. You hereby grant us an unrestricted, irrevocable, worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, adapt, create derivative works from, publish, transmit, communicate to the public, perform and display any of your Content in connection with the provision, operation, maintenance, development, marketing and improvement of the Service and for other business needs of Laguna Jobs. You accept that this means that we are able to use and exploit the Content in any manner and by any means, method or technology (whether now known or hereafter created) and for such purposes (including but without limitation to promoting part or all of the Service). This section does not affect your rights nor our obligations under the Laguna Jobs Privacy Policy.
    3. You irrevocably and unconditionally waive any and all moral rights in any Content.
    4. You are solely responsible for your Content and the consequences of posting or publishing it. We do not endorse any Content or any opinion, recommendation, or advice expressed therein. You also acknowledge that we have no liability in connection with the Content and we cannot guarantee and will not be liable for any unauthorised copying, distribution or use of your Content.
    5. By uploading and publishing your Content you warrant, represent and undertake that you are the creator and owner of the Content, have the right to grant us the rights contain in these Terms of Service and that you will comply with all your obligations regarding uploading content to our Service including without limitation those set out at clause 2.1, above. You warrant that the Content is accurate and complete in all material respects and you have (and will continue to have during your use of the Service) all necessary licences, rights consents and permissions which are required to enable us to use your Content as contemplated by these Terms of Service.

  5. Business Partner’s Payment Obligations
    1. Business Partner agree to pay to Laguna Jobs the total amount payable in respect of any job hiring, including but not limited to an amount to fully and properly account for any payment in lieu of holiday that is or would become due and payable to the Talent in accordance with applicable laws;
    2. Where applicable, Laguna Jobs shall charge VAT to the Business Partner at the prevailing rate.
    3. Business Partner agreed to the following:
      1. Business Partner acknowledge that Talents’ timesheets are calculated automatically from the time a Talent logs on to the Service to attend their Engagement or Shift (as applicable), and until such time as he/she logs off having completed his/her Shift/Engagement. Business Partner agree that all timesheets for the preceding week must be approved by the Business Partner by 11.59PM GMT on the following Tuesday. Where the Client fails to approve a timesheet on time, such timesheet shall be deemed to have been approved by the Business Partner and the Business Partner shall be liable to pay for all of the time recorded on such timesheet.
      2. Every Wednesday (unless it is a Thai public holiday, in which case on the next working day) Laguna Jobs shall provide the Business Partner with an invoice setting out the details of all the Shifts/Engagements completed by Talents engaged by the Business Partner for the preceding week (for the avoidance of doubt, this means all Shifts/Engagements completed between 00:00 on Monday until 23:59 on Sunday during the same week).
      3. Unless otherwise agreed, the Business Partner shall pay all invoices by bank transfer within 14 (fourteen) days of the date of an undisputed invoice in the currency in which the invoice is rendered. Any amounts not paid when due shall bear interest until paid at the monthly rate of 4% above the then current base lending rate of the Bank of Thailand
      4. Laguna Jobs may, with or without notice, suspend or terminate the Business Partner’s access to the Service if the business partner is more than fourteen (14) days late in paying any undisputed invoice.

  6. Terms of Engagements
    1. In respect of each Engagement, Talent shall be engaged by Business Partner under a contract for services. Talent act for and under the control of Business Partner for the duration of each Engagement. Laguna Jobs and its Group Companies are not responsible for the actions, omissions, negligence or misconduct of Talents or Business partners.
    2. When posting a job Assignment (or at any time following a request from Laguna Jobs for the same), the business partner will provide Laguna Jobs with details of:
      1. the date on which the business Partner requires the talent to commence work and the duration, or likely duration, of that work;
      2. the position which the business partner is seeking to fill, including the type of work the talent would be required to do, the location at which, and the hours during which, the talent would be required to work, and any risk to health or safety known to the business partner and what steps the business partner has taken to prevent or control such risks;
      3. the rate at which the talent would be paid;
      4. the experience, training, qualifications and any authorization which the business considers necessary, or which are required by law, or any professional body, for the talent to possess in order to work the Engagement;
      5. any expenses payable by or to the Talent; and
      6. any information reasonably required by Laguna Jobs in order for Laguna Jobs to fulfil its obligations under the Agency Regulations and/or the Conduct Regulations.
    3. The business partner agrees that the rate at which each Talent is paid for any Engagement shall be at least the greater of:
      1. the total of (i) the minimum wage rate under applicable laws as amended from time to time, and (ii) an amount to fully and properly account for any payment in lieu of holiday that is or would become due and payable to the talent in accordance with applicable laws; or
      2. where the talent performing the Engagement is a Qualifying talent, the total of (i) such payment rate as is required for the business partner and Laguna Jobs to comply with their obligations under regulation 5 of the Agency Regulations, and (ii) an amount to fully and properly account for any payment in lieu of holiday that is or would become due and payable to the Talent in accordance with applicable laws, and hereby warrants to Laguna Jobs that any amounts specified for an Assignment shall be in compliance with this clause 6.3.
    4. At the time when a Talent applies for an Engagement, the Business partner shall have access to the following information:
      1. the identity of the Talent;
      2. the Talent’s experience, training, qualifications and authorizations which are necessary for the Engagement
    5. The Business Partner shall in respect of any Engagement that involves food preparation, provide each Talent with appropriate on-site health and safety training, as may be required by law or otherwise.
    6. The Business Partner shall not, during the course of any Engagement, direct a Talent to work other than in accordance with the terms of the relevant Assignment (as posted by the Business partner on the Service).
    7. The Business partner acknowledges and agrees that a Talent may cancel an Engagement at any time without any prior notice and without any liability on the part of Laguna Jobs.
    8. Business partner requests to change or cancel an Engagement must be submitted to Laguna Jobs’s customer service via the Service. Alternatively, requests may also be submitted on 076 362300 or via email Lagunajobs@lagunaphuket.com
    9. The Business partner acknowledges that a Talent may refuse to work past the contracted times agreed under the terms of an Engagement. Where the Talent agrees to work overtime, such overtime shall be payable by the Business partner at the same hourly rate (plus amounts in respect of the Service Fees, payment in lieu of accrued but untaken holiday) as the rate that has been agreed under the terms of the relevant Engagement. The Business Partner shall be liable to pay for all expenses reasonably incurred by the Talent as a result of working overtime (including without limitation food and travel expenses). Such additional expenses shall be clearly set out on any invoices submitted to the Business partner.
    10. Laguna Jobs assumes responsibility for the payment of remuneration (including any pay in lieu of accrued but untaken holiday) to Talents and the deduction and payment of all tax, and other levies applicable to Talents, as required by law.
    11. The Business partner shall not, unless specified in the Assignment, cause or permit Talents to handle or have access to cash or other valuables during any Engagement. The Business Partner acknowledges that in all cases, the Business Partner shall have sole responsibility for any loss suffered as a result of the Talent’s handling of cash/valuables in question.
    12. You agree that Laguna Jobs may call or text you to facilitate the performance of any of your Engagements.

  7. Liability
    1. Nothing in these Terms of Service limits or excludes Laguna Jobs liability for: (i) death or personal injury by our negligence; (ii) fraudulent misrepresentation; or (iii) any other liability that cannot be excluded by law.
    2. To the extent permitted by law, Laguna Jobs exclude all conditions, warranties, representations or other terms which may apply to the Service or any content on it, whether express or implied.
    3. We will not be liable to you for any lack of performance, or the unavailability or failure of the Service or our services, or for any failure by us to comply with these Terms of Service, where such lack, unavailability or failure arises from any cause reasonably beyond our control. In no event shall we be liable for any claim, damage, or loss which may be incurred by you as a result of any of your transactions involving our Service (including the engagement of Talent via our Service). Any liability we do have for losses you suffer is strictly limited to the monies that we have received from you in connection with your Engagements. We are not responsible for any loss or damage that is not foreseeable at the time when you begin using the Service.
    4. If you are a consumer, you are entitled to various statutory warranties (including, for example, that any service is carried out with reasonable care and skill, and any digital content provided is of satisfactory quality). Nothing in these Terms of Service shall have the effect of excluding or limiting those statutory warranties that may not be excluded or limited by law.
    5. Talent engaged via the Service perform the Engagements under the direction and control of the Business partner. Laguna Jobs provides matchmaking and platform services only and Business Partner agree that Laguna Jobs has no responsibility for any other aspect of service delivery or interaction between Talent and Business Partner.

  8. Indemnity
    1. The business partner hereby acknowledges and agrees to indemnify and keep indemnified Laguna Jobs, each of Laguna Phuket Group Companies and each of its and their officers, directors, agents and employees against any claim or demand, including legal fees and costs, made against us by any third party due to or arising out of your negligence, misrepresentation or breach of these Terms of Service, or your infringement or alleged infringement of any law (including, without limitation, the Agency Regulations and the Conduct Regulations) or the rights of a third party in the course of using the Service.
    2. Laguna Jobs can apply any funds owed to business partner against any liabilities business partner owe to Laguna Jobs or loss suffered by Laguna Jobs as a result of your non-performance or breach of these Terms of Service.

  9. In case of a dispute And dispute management
    1. In the event of a dispute arises between the Talent and the Business partners who agrees to engagement on the application. Must be negotiated and to find a way out of wisdom. But if the agreement cannot be reached, both parties can contact the Laguna jobs to help coordinate the resolution along with sending evidence documents. Laguna Jobs' verdict considered the best.
    2. But if it is an agreement for employment outside the application, the Laguna Jobs hereby denies responsibility and any damages, even if the Talent is not paid or In the event that the business partner does not receive the service as agreed or there is damage to the body or property or any other damage in all cases. The parties have to negotiate the dispute among themselves. Because Laguna Jobs is not involved and has no policy to agree to hire outside the application in any way

  10. Termination
    In the event that any information provided by the user is inaccurate, in breach of any laws or contains indecent elements, Laguna Jobs shall instantly abrogate the user’s account and membership without notice and reserves the right to take any action as it considers appropriate, desirable or necessary, including but not limited to taking legal action against such user. Laguna Jobs reserves the right at any time to immediately terminate or suspend any user’s account or access to the Site without notice, where Laguna Jobs is of the opinion that the user has breached any of the Terms and Conditions or violated any law or regulation, and to take further action as Laguna Jobs in its sole discretion considers appropriate, desirable or necessary, including removing any material which it deems abusive, illegal, disruptive or inappropriate. Laguna Jobs shall have the sole and absolute discretion to decide whether the user, Job Seeker or Advertiser has breached any of the Terms and Conditions, and such decision shall be final. In case Laguna Jobs has not exercised the right under this Clause, it shall not be deemed to be a waiver.

  11. Data Protection Clause
    Laguna Jobs has taken every reasonable steps to complied and will continue to comply with its obligations as a data processor arising from the data protection and privacy laws in force from time to time to the extent that those obligations are relevant to this Agreement. Further, we have taken steps to implement and shall maintain an information security program including reasonable administrative, technical and physical measures designed to secure and protect the confidentiality, integrity and availability of all Confidential Information while in such party’s possession against unauthorized, unlawful or accidental access, disclosure, transfer, destruction, loss or alteration. The term Confidential Information will not, however, include any information that identifies or directly relates to natural persons (“Personal Data”). Each party will exercise commercially reasonable efforts not to disclose any Personal Data to the other party and to restrict the other party’s access to its Personal Data, but if a party is given access to the other party’s Personal Data, the receiving party will protect such Personal Data using a reasonable standard of care.

  12. Variation of Terms
    1. Laguna Jobs may vary these Terms at any time. If Laguna Jobs varies these Terms, it will provide notice by publishing the varied Terms on the Site.
    2. You accept that by doing this, Laguna Jobs has provided you with sufficient notice of the variation to its Terms.

  13. Governing Law
    Terms and conditions of use of this service to be enforced and interpreted in accordance with Thai law and the Thai court shall be the court having the jurisdiction to consider disputes arising in connection with the use of the service in accordance with these terms and conditions.
